Definitions

Affiliates

All personnel with login access to the Smoke Arsenal wholesale website.

Company

A customer assigned a Smoke Arsenal account number.

Canada Peach-Stamped Vaping Products

Vaping products where only federal excise duty has been paid (no provincial duty). These products may only be sold to consumers in British Columbia (BC), Saskatchewan (SK), and Newfoundland and Labrador (NL).

Certification

A formal declaration signed by an authorized representative who can legally bind the Company.

Federal Excise Vaping Products

Canada Peach-Stamped Vaping Products (as defined above).

Smoke Arsenal

Smoke Arsenal (the wholesale supplier).

Certification Agreement

By submitting this certification, the Company confirms that:

  • Accuracy: All provided information is true, complete, and accurate.
  • No Misrepresentation: No information has been falsified or omitted.
  • Webstore Ownership: Any submitted webstore is owned by or legitimately associated with the Company.
  • Access Control: The Company is responsible for controlling which Affiliates can access federal excise vaping products.
  • Legal Compliance: The Company and its Affiliates will comply with all applicable laws, including the Excise Act, 2001 (the “Act”), when purchasing, distributing, and selling these products.

Eligibility

  • Certification is submitted through the application process and is used to determine eligibility.
  • All information may be verified.
  • Continued access to purchase federal excise vaping products depends on ongoing compliance with the Act.

Changes in Status

The Company must immediately notify Smoke Arsenal if:

  • It no longer meets eligibility requirements; or
  • It no longer intends to purchase federal excise vaping products.

Non-Compliance

Any false, incomplete, or misleading information may result in loss of eligibility to purchase federal excise vaping products until compliance is proven.
